These Terms govern your use of Wild Springs (Nairobi Mountain & Hiking Gear Store), our website wildsprings.co.ke/shop, our physical store at Valley View Office Park, Parklands, Nairobi, and all purchases you make from us.
By using our site, visiting our store, or placing an order, you confirm you have read, understood, and accepted these Terms. If you do not agree, please do not use our services.

1. WHO WE ARE
Wild Springs is operated by Wild Springs Adventures Limited, a company registered in Kenya. Our shop is located at Valley View Office Park, Tower A, First Floor, Room 4, Sixth Avenue Parklands, off Limuru Road, Nairobi.

2. PRODUCTS, PRICING & STOCK
All prices are listed in Kenyan Shillings (KSh) and include VAT where applicable. Prices in USD are indicative — final pricing converts to KSh at checkout.
PRICING ERRORS: Occasionally, prices may display incorrectly. If we discover a pricing error after you place an order, we will contact you with the correct price. You may then choose to confirm at the correct price or cancel for a full refund. We reserve the right to cancel any order with an obvious pricing error.
STOCK AVAILABILITY: Listed stock is indicative. If an item is unavailable after you order, we contact you within one business day with options:
- Wait for restock (with our estimated date)
- Choose an alternative item
- Receive a full refund
We do not guarantee continuous availability of any specific product, brand, or size.
PRODUCT IMAGES: Slight variations in colour, finish, or detail may occur due to screen settings, lighting, or batch differences from manufacturers. Such variations are not grounds for return.
GENTLY USED ITEMS: These pre-owned products are sold as-is and inspected before listing. They carry no return rights beyond confirmed manufacturer defects discovered within 48 hours of delivery.

3. ORDERS, PAYMENT & DELIVERY
PLACING AN ORDER: When you submit an order through our site, this is an offer to buy. We accept the offer when we send order confirmation. We may decline any order at our discretion.
PAYMENT METHODS: M-Pesa, Visa, Mastercard, bank transfer, and cash on delivery (Nairobi only). Card payments are processed by certified third-party providers; we do not store card details.
DELIVERY: Delivery times are estimates, not guarantees. We are not liable for delays caused by:
- Couriers, postal services, or third-party logistics partners
- Weather, road conditions, or strikes
- Incorrect delivery information provided by you
- Customs or import procedures (international orders)
TITLE AND RISK: Risk passes to you upon delivery to the address you provided. If delivery fails because no one is available to receive the order, additional delivery fees may apply.

4. RETURNS
Returns are governed by our Return Policy at wildsprings.co.ke/shop/return-policy, which forms part of these Terms.

5. WARRANTIES & PRODUCT LIABILITY — IMPORTANT
We sell outdoor gear manufactured by third parties. We do not manufacture products and do not certify product performance, durability, or safety beyond what the manufacturer warrants.
WARRANTY: Manufacturer warranties apply where offered. We will assist you in submitting warranty claims to the manufacturer, but we do not provide our own warranty beyond statutory rights under the Consumer Protection Act 2012 of Kenya.
INHERENT RISKS OF OUTDOOR ACTIVITY: Hiking, mountaineering, climbing, camping, trekking, and all outdoor activities involve INHERENT RISKS — including, but not limited to:
- Injury, illness, or death
- Falls, slips, and impact injuries
- Hypothermia, heatstroke, dehydration
- Altitude sickness on Mt Kenya, Kilimanjaro, and other high peaks
- Equipment failure due to misuse, age, wear, weather, or unforeseen conditions
- Wildlife encounters
- Loss or damage to personal property
By purchasing gear from us, you acknowledge these risks and accept full responsibility for using the gear correctly, within its manufacturer-rated limits, and for activities suitable to your experience and fitness level.
LIMITATION OF LIABILITY: To the maximum extent permitted by Kenyan law, Wild Springs shall not be liable for:
- Personal injury, illness, or death resulting from product use, misuse, or activity
- Lost or damaged personal items during outdoor use
- Indirect, consequential, or incidental damages — including lost trips, missed flights, or ruined holidays
- Damages exceeding the original purchase price of the product in question
This limitation does not affect your statutory rights for genuinely defective goods under the Consumer Protection Act 2012.

6. YOUR RESPONSIBILITIES
You agree:
- To provide accurate personal and delivery information when ordering
- Not to use our site for any unlawful purpose
- Not to attempt unauthorised access to our systems
- Not to scrape, copy, or republish our product descriptions, images, or content
- To use products responsibly and within their intended use
- To follow manufacturer instructions and care guidelines

7. INTELLECTUAL PROPERTY
All content on wildsprings.co.ke — including text, product descriptions, photographs, logos, layouts, code, and graphics — is owned by Wild Springs or licensed to us. You may not copy, reproduce, scrape, or redistribute any of it without written permission.
Brand logos and trademarks belong to their respective owners.

8. ACCOUNT TERMS
If you create an account on our site, you agree to:
- Keep your login credentials secure
- Not share your account with others
- Notify us immediately of any unauthorised access
- Provide truthful information
We may suspend or close any account that violates these Terms.

9. FORCE MAJEURE
We are not liable for failure to perform our obligations due to events outside our reasonable control — including natural disasters, pandemics, government action, internet outages, supplier failures, currency restrictions, and civil unrest.

10. INDEMNIFICATION
You agree to indemnify and hold harmless Wild Springs Adventures Limited, its directors, employees, and agents from any claim, loss, or damage arising from your use of products purchased from us, your breach of these Terms, or your violation of any law or third-party right.

11. GOVERNING LAW & DISPUTES
These Terms are governed by the laws of Kenya. Any dispute will be resolved through:
Step 1 — Direct negotiation: contact us first via [email protected] or phone. We resolve most issues within one week.
Step 2 — Mediation: through a Kenyan-accredited mediator.
Step 3 — Courts: the courts of Nairobi, Kenya, have exclusive jurisdiction.
